Intentional Program Violation (IPV) - Overview

An intentional program violation (IPV) is an intentional act committed by an individual designated as a violation through a disqualification hearing. These acts include, and are not limited to, any of the following:
●Making false or misleading statements.
●Misrepresenting, concealing, or withholding facts.
For CA, committing any act intended to mislead, misrepresent, conceal, or withhold facts.
For NA, committing an act that violates NA regulations regarding the use of NA benefits in any of the following ways:
●Acquisition.
Obtaining NA benefits by providing false or misleading statements, or misrepresenting, concealing, or withholding facts in order to establish or maintain eligibility for NA.
●Possession.
The physical act of controlling NA benefits on an Electronic Benefit Transfer (EBT) card when eligibility was established or maintained via false or misleading statements, or misrepresenting, concealing, or withholding facts.
●Presentation.
Attempting to use NA benefits on an EBT card when the NA benefits were obtained by providing false or misleading statements, or misrepresenting, concealing, or withholding facts in order to establish or maintain eligibility for NA.
●Receipt.
Receiving NA benefits when eligibility was established or maintained via false or misleading statements, or misrepresenting, concealing, or withholding facts.
●Transfer.
Allowing someone else to use the NA benefits to purchase eligible food items when the items purchased are not returned to the
budgetary unit(g) approved to receive NA benefits. This act also includes using someone else’s NA benefits when the items purchased are not returned to the budgetary unit approved to receive NA benefits.
The reasons an IPV may be committed include, and are not limited to any of the following:
●Establishing or maintaining eligibility for benefits.
●Increasing or preventing a reduction in the amount of benefits.
