IPV - Referral for Prosecution
The Office of Accounts Receivable and Collections (OARC) refers the following overpayments to the Office of Special Investigations (OSI):
 
All Intentional Program Violation household error overpayments of $2000 or more.
Household error overpayments of less than $2000 when previously discovered or enhanced by prior OSI investigations.
 
OSI refers appropriate cases to either of the following in accordance with an agreement with the prosecutors:
 
The Attorney General's office
Other criminal prosecutor offices having jurisdiction
 
A participant may be referred for prosecution, regardless of whether the participant is receiving benefits. The following apply based on the specific program:
 
For NA, the prosecutors encourage the courts to recommend disqualification penalties and provide for restitution.
For CA, pending the prosecution proceedings, the participant continues to receive benefits, when eligible, based on current circumstances.
