IPV - Disqualification Procedures

The initial month of an Intentional Program Violation (IPV) disqualification is as follows for budgetary units currently receiving benefits:
 
The first month following the month the household receives the Notice of Disqualification for Intentional Program Violation from the Office of Accounts Receivable and Collections (OARC) advising of the disqualification.
When a Waiver of the Right to an Administrative Disqualification Appeal (OAR5 for CA and OARC1 for NA) form is signed, the disqualification begins the month following the month the notice is received by the household.
 
NOTE OARC sends the Notice of Disqualification for Intentional Program Violation the same month the Waiver is received or no later than the following month.
 
When the court specifies the date for initiating the disqualification period, FAA disqualifies the participant in accordance with the court order. Otherwise, the disqualification is applied beginning with the first month possible when any of the following occur:
The disqualification was ordered by a court of appropriate jurisdiction.
A disqualification consent agreement was signed.
 
For NA, when the participant is currently receiving benefits, FAA disqualifies the participant within 45 calendar days of any of the following:
 
The date the disqualification was ordered by the court.
The date the disqualification consent agreement was signed.
 
When the participant is not receiving benefits or is ineligible for the program at the time the disqualification period begins, complete the following:
 
Apply the disqualification period immediately.
Document the disqualification period in the case file(g).
 
 
No months will be suspended or postponed for lack of participation or ineligibility.
 
When the household reapplies during the disqualification period and is found eligible, complete the following:
 
Disqualify the IPV participant for the number of months remaining in the disqualification period
Advise OARC of the disqualification action
 
When the household reapplies after the disqualification period and is eligible, include the IPV participant.
 
When FAA fails to impose disqualification in a timely manner, disqualify the participant for the number of months remaining in the disqualification period. Write an overpayment for the months in which the participant should have been disqualified but was not.
