IPV - Referral for Prosecution
The Office of Accounts Receivable and Collections (OARC) refers the following overpayments to the
Office of Special Investigations (OSI):
●All Intentional Program Violation household error overpayments of $2000 or more.
●Household error overpayments of less than $2000 when previously discovered or enhanced by prior OSI investigations.
OSI refers appropriate cases to either of the following in accordance with an agreement with the prosecutors:
●The Attorney General's office
●Other criminal prosecutor offices having jurisdiction
A participant may be referred for prosecution, regardless of whether the participant is receiving benefits. The following apply based on the specific program:
●For NA, the prosecutors encourage the courts to recommend disqualification penalties and provide for restitution.
●For CA, pending the prosecution proceedings, the participant continues to receive benefits, when eligible, based on current circumstances.
