IPV - Administrative Disqualification Appeal - Time Frames

The Office of Appeals must send a written hearing notice by first class mail, certified mail - return receipt requested, or any other reliable method, no later than 30 calendar days before the scheduled hearing date when one of the following occurs:
 
The individual suspected of an IPV does not sign and return the waiver of Administrative Disqualification Hearing by the return date set in the waiver notice.
The individual suspected of an IPV returns the waiver notice stating they do not waive the Administrative Disqualification Hearing.
 
Within 90 days of the date the appeal notice is mailed to the household, Appellate Services Administration (ASA) completes the following:
 
Conducts the administrative disqualification appeal.
Arrive at a decision.
Notify the following of the decision:
Household
Central office
Region office
Overpayment Unit
Office of Accounts Receivable and Collections (OARC)
 
The household or their representative is entitled to a postponement of the appeal for up to 30 calendar days, provided the request for postponement is made at least ten calendar days in advance of the scheduled appeal. The number of postponements is limited to one.
