Based on the monthly compromise discretionary income, use the following chart to determine the NA Overpayment compromise amount:

Compromise discretionary income equals $100.01 but does not exceed $200.00
Multiply the compromise discretionary income by 25%.
 
Multiply that amount by 36 months.
 
Example:
$150 x 25% = $37.50 x 36 = $1,350
 
Eligible for compromise
When the overpayment balance is greater than $1,350, the claim can be compromised to $1,350.
 
Ineligible for compromise
When the overpayment balance is equal to or below $1,350, deny the request to compromise.
Discretionary income equals $200.01 but does not exceed $300.00
Multiply the compromise discretionary income by 30%.
 
Multiply that amount by 36 months.
 
Example:
$250 x 30% = $75.00 x 36 = $2,700
 
Eligible for compromise
When current overpayment balance is greater than $2,700, the balance can be compromised to $2,700.
 
Ineligible for compromise
When current overpayment balance is equal to or below $2,700, deny the request to compromise.
Discretionary income equals $300.01 but does not exceed $500.00
Multiply the compromise discretionary income by 35%.
 
Multiply that amount by 36 months.
 
Example:
$350 x 35% = $122.50 x 36 = $4,410
 
Eligible for compromise
When current overpayment balance is greater than $4,410, the balance can be compromised to $4,410.
 
Ineligible for compromise
When current overpayment balance is equal to or below $4,410, deny the request to compromise.
Discretionary income is equal to or exceeds $500.01
Deny the compromise.
