IPV - Administrative Disqualification Appeal - Telephone Appeal Process
Policy and procedures regarding the Intentional Program Violation (IPV) telephone appeal process are as follows for the specified program:
 
For CA, telephone appeals may be scheduled. However, the household must be advised that they may choose to appear in person rather than by telephone. When a telephone appeal is scheduled, the suspected participant must be advised of the following:
They have the same rights as at a face-to-face appeal to present their defense
They may examine documentary evidence, cross-examine adverse witnesses and submit evidence
For NA, the household must be given the option of choosing a face-to-face appeal instead of a telephone appeal. The suspected participant must be advised in writing, of the following:
A face-to-face appeal with the appeal office may be requested
The decision to not request a face-to-face appeal should be carefully considered
The disqualification penalties for a telephone appeal are the same as for a face-to-face appeal
Should the suspected participant agree to a telephone appeal, the participant must sign a form indicating that they have freely consented to having a telephone disqualification appeal and that they understand the following:
They have the same rights as at a face-to-face appeal to present their defense
They may examine documentary evidence, cross-examine adverse witnesses and submit evidence
