Domestic Partner Definition
A relationship is a Domestic Partnership when the two people meet ALL of the following criteria:
●Share a permanent residence, and have been residing with one another continuously for at least a year.
●Have not declared to be a domestic partner with any other person within the prior year.
●Do not currently have any other domestic partner or
spouse(g) of the same or opposite sex.
●Are not currently married to anyone or legally separated from anyone else.
●Are not blood relatives any closer than would prohibit marriage in Arizona.
NOTE First cousins may marry if both are sixty-five years of age or older. If one or both first cousins are under sixty-five years of age, they can marry if they show proof to a superior court judge that one of them is unable to reproduce.
●Are mentally competent to consent to the domestic partnership.
The two people meet the criteria unless documentation is provided that verifies one or both are not mentally competent to consent to the domestic partnership.
●Are at least 18 years of age.
●Are connected to each other financially, and meet at least three of the following criteria:
Have a joint mortgage, joint property tax identification, or a joint lease.
Hold a joint credit or bank account.
Assume joint liabilities, such as being signers or cosigners on any loan or purchase.
Have joint ownership of real estate, a vehicle or boat.
Name the partner as a beneficiary on the participant's life insurance, will, or retirement annuities AND are named by the partner as a beneficiary on the partner's life insurance, will or retirement annuities.
