Common Law States Definition
 
States in which persons can be married by common law are the following:
 
Alabama
Colorado
District of Columbia
Georgia (when common law relationship was established prior to 01/01/97)
Idaho (when common law relationship was established prior to 01/01/96)
Iowa
Kansas
Montana
Ohio (when common law relationship was established prior to 01/01/91)
Oklahoma (when common law relationship was established prior to 11/01/98)
Pennsylvania
Rhode Island
South Carolina
Texas
Utah
 
Navajo Tribal members living as man and wife may be recognized as married by common law.
 
WARNING
The common law relationship continues when the participant moves to Arizona or when they move off the Tribal Land.
