Appeals – Appeals Filed by FAA
FAA may appeal an adverse decision issued by an Administrative Law Judge (ALJ) to the Department’s Appeals Board. FAA must file the written
petition for review(g) with the Office of Appeals within 15
calendar days(g) of the mailing or transmittal date of the ALJ’s decision.
The petition for review shall:
●Be submitted by the Attorney General's (AG) office on behalf of FAA unless otherwise directed by the AG office
●Be in writing
●Filed in person, by mail, email, or fax
●Describe why the AG and FAA disagree with the hearing officer’s decision
●Be signed and dated by the party or the party’s representative
