E Appeal Hearings - Pascua Yaqui Tribal TANF

A Pascua Yaqui Tribal TANF Program participant has the right to appeal any decision that impacts their benefits negatively.
 
Appeal Hearings for Pascua Yaqui Tribal TANF must be requested within 20 calendar days of the date the eligibility determination notice is mailed. The request must be in writing, state what action or decision is being appealed, and what remedy is proposed.
 
When a hearing is requested for a Pascua Yaqui Tribal TANF determination, complete the following:
 
An Eligibility Worker must meet with the participant requesting the appeal within seven calendar days of the hearing request to discuss the appeal.
Based on the discussion and information in the case file(g), the Eligibility Worker makes a determination on the original decision.
When the participant disagrees with the Eligibility Worker’s decision, the Local Office Manager (LOM) must review the documents submitted to the Eligibility Worker and determine if the decision is correct. The LOM review must be completed within one working day of the Eligibility Worker’s decision.
When the participant still disagrees with the decision, they may request a meeting with the Region Program Manager (RPM). The request must be made within three calendar days of the Eligibility Worker’s decision.
The RPM examines the facts and makes a decision.
When the participant still disagrees with the decision, they can request a meeting with the DBME Assistant Director (AD). The request must be made within three calendar days of the RPM's decision.
The DBME AD reviews the documents submitted to the Local Office and RPM, and meets with the participant.
The DBME AD submits their findings to the participant and FAA.
 
EXCEPTION
The PY YOEME Services – Pre-Compliance Office staff are responsible for appeals related to PY YOEME Services noncompliance situations. FAA is responsible for hearings related to the benefit amount determination following noncompliance.
