.03 NA E&T LP Selection Rules-More Than One Adult Without Children
When there is more than one adult and the budgetary unit does not include children, determine the NA E&T LP as the adult participant who has the greatest total of earnings in the two-month period prior to the following applicable situations:
 
The date of application at initial approval
The date of the E&T noncompliance report when being determined for an active NA case. (See E&T Noncompliance)
The date a new disqualified participant is being added to the existing budgetary unit. (See E&T Noncompliance)
Determine whether the NA E&T LP has employment that meets either of the following criteria:
Involves 20 or more hours per week
Provides weekly earnings at least equal to the federal minimum wage multiplied by 20
 
Designate the NA E&T LP at the interview when there are two participants with identical earnings.
 
Designate the NA E&T LP with the best interests and preferences of the budgetary unit.
 
WARNING
The NA E&T LP cannot be any of the following:
A participant who is exempt from E&T participation because of physical or mental disability.
A participant, of any age, who is living with a parent (or someone acting as a parent) when the parent is either of the following:
Registered for work
Exempt from work registration for any of the following reasons:
Mandatory Jobs participation
Receipt of UI
Registration for work as part of the UI application process
Employment (or self-employment), working at least 30 hours per week
Employment (or self-employment), receiving earnings equal to the federal minimum wage multiplied by 30 hours
 
Inform the PI at each interview of the identity of the NA E&T LP. Document the identity of the NA E&T LP on the case file(g) at each interview.
