.08 Victim of Severe Trafficking

A victim of severe trafficking is certified by the Office of Refugee Resettlement (ORR) to have been subjected to one of the following:
 
Commercial sex acts
Debt bondage
Involuntary servitude
Peonage
Slavery
 
The following apply to trafficking victims:
 
They are not considered refugees by USCIS
USCIS Arrival / Departure documents are not required
The Trafficking Victim Protection Act of 2000 gives trafficking victims eligibility for the same benefits as refugees
 
A victim of severe human trafficking is potentially eligible for CA, NA, and full services MA.
 
A certified victim and the immediate family members of severe trafficking who are later granted Lawful Permanent Resident (LPR) status are potentially eligible for CA, NA, and full services MA based on their previous status.
